Cold Air Club Property Maintenance Services

1. ACCEPTANCE OF TERMS

By scheduling services with Cold Air Club or using our website at www.coldairclub.com, you ("Customer," "You," or "Property Owner") agree to be bound by these Terms and Conditions. These terms apply to all property maintenance services, air filter replacement services, and related services provided by Cold Air Club in Palm Beach County, Florida.

2. SERVICES PROVIDED

2.1 Service Description

Cold Air Club provides monthly air filter replacement, property inspections, and property maintenance services for rental properties, investment properties, vacation rentals, and residential properties throughout Palm Beach County, including Boca Raton, Delray Beach, West Palm Beach, and surrounding areas.

2.2 Service Plans

  • Essential Care Plan: Monthly service at $49.99/month

  • Standard Care Plan: Bi-monthly service at $79.99 every two months

  • Premium Care Plan: Bi-monthly service at $129.99 every two months

2.3 Additional Services

Additional services such as thermostat installation, emergency calls, and specialized maintenance are available at separately quoted rates.

3. SUBSCRIPTION AND BILLING

3.1 Month-to-Month Service

All service plans are month-to-month subscriptions with no long-term contracts required. Services will automatically renew each billing cycle until cancelled.

3.2 Payment Terms

  • Payment is due in advance of service

  • Automatic billing will occur on the same date each month/billing cycle

  • Accepted payment methods: Credit card, ACH, check

  • Late fee of $25 applies to payments more than 10 days past due

3.3 Price Changes

Cold Air Club reserves the right to modify pricing with 30 days written notice to customers.

4. CANCELLATION POLICY

4.1 Customer Cancellation

Customers may cancel anytime by providing 7 days written notice via email to info@coldairclub.com or by calling our office. No cancellation fees apply.

4.2 Refund Policy

  • No refunds for services already performed

  • Pro-rated refunds may be provided for prepaid services not yet performed

  • Refund requests must be submitted within 30 days

5. PROPERTY ACCESS

5.1 Access Authorization

Customer grants Cold Air Club and its technicians permission to access the property during scheduled service appointments for the purpose of performing air filter replacement and property maintenance services.

5.2 Access Methods

  • Lockbox installation (with customer approval)

  • Tenant coordination for occupied rental properties

  • Property manager coordination

  • Customer presence during service

5.3 Access Issues

If access cannot be obtained during scheduled appointments, rescheduling fees of $25 may apply for subsequent appointment changes.

6. LIMITATION OF LIABILITY

6.1 Service Limitations

Cold Air Club provides property maintenance and air filter replacement services only. We are not responsible for:

  • Pre-existing HVAC system problems

  • Damage caused by faulty equipment or systems

  • Property damage not directly caused by our negligence

  • Tenant-related issues or damages

6.2 Liability Cap

Cold Air Club's total liability for any claim shall not exceed the amount paid by customer for services in the 12 months preceding the claim.

6.3 Insurance Coverage

Cold Air Club maintains general liability insurance and workers compensation as required by law. Customer should maintain their own property insurance.

7. PROPERTY OWNER RESPONSIBILITIES

7.1 Property Condition

Customer warrants that:

  • Property systems are in working order

  • Safe access to HVAC systems and service areas

  • Property managers and tenants are notified of service schedules

  • Property complies with local safety codes

7.2 Communication

Customer must provide:

  • Accurate contact information

  • Property manager contact details if applicable

  • Access instructions and any special requirements

  • Prompt notification of any changes to property access

8. WARRANTIES AND DISCLAIMERS

8.1 Service Warranty

Cold Air Club warrants that services will be performed by licensed professionals in accordance with industry standards.

8.2 Equipment Warranty

  • Air filters: Manufacturer warranty applies

  • Thermostat installations: Equipment manufacturer warranty applies

  • Labor warranty: 30 days on installation services

8.3 Disclaimers

COLD AIR CLUB MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE, BEYOND THOSE EXPRESSLY STATED HEREIN.

9. INDEMNIFICATION

Customer agrees to indemnify and hold harmless Cold Air Club from claims arising from:

  • Customer's failure to maintain property insurance

  • Tenant-related issues or tenant injuries

  • Pre-existing property conditions or defects

  • Customer's breach of these terms

10. FORCE MAJEURE

Cold Air Club shall not be liable for delays or failure to perform due to circumstances beyond our control, including but not limited to: natural disasters, hurricanes, government actions, labor disputes, or equipment failures.

11. DISPUTE RESOLUTION

11.1 Governing Law

These terms are governed by Florida state law and Palm Beach County jurisdiction.

11.2 Dispute Process

  1. Direct communication with Cold Air Club management

  2. Mediation through Florida mediation services

  3. Binding arbitration if mediation fails

  4. Small claims court for disputes under $8,000

12. PRIVACY POLICY

12.1 Information Collection

We collect customer information necessary to provide property maintenance services including:

  • Contact information and property addresses

  • Property access codes and instructions

  • Service history and property condition reports

12.2 Information Use

Customer information is used solely for:

  • Providing contracted services

  • Property maintenance scheduling and reporting

  • Customer communication and billing

  • Service quality improvement

12.3 Information Protection

We do not sell or share customer information with third parties except as required for service delivery (e.g., property managers, emergency contacts).

13. GENERAL PROVISIONS

13.1 Entire Agreement

These terms constitute the complete agreement between parties and supersede all prior agreements.

13.2 Modifications

Terms may only be modified in writing or through updated website posting with customer notification.

13.3 Severability

If any provision is deemed invalid, the remaining terms remain in full effect.

13.4 Assignment

Customer may not assign this agreement without written consent. Cold Air Club may assign with customer notification.
